Dear Mr. Smith:

Defendant Harold W. Smith, Jr. ("defendant") has filed a motion for postconviction relief pursuant to Superior Court Criminal Rule 61 alleging ineffective assistance of counsel with regard to his violation of probation ("VOP") hearing which took place on September 27, 2013.[1]As the Delaware Supreme Court has explained: "Because there is no constitutional right to counsel at a VOP hearing, ... [a defendant's] purported ineffective assistance of counsel claim ... must fail."[2]

Thus, defendant's motion for postconviction relief is denied.[3]
