UNREPORTED OPINION

This is an action for the costs of coating and repairing the roof on defendant's warehouse.

In July of 1967 plaintiff was requested by Roger Pernick, agent for defendant corporation, to coat the roof of defendant's warehouse located on Liberty Street in the City of Wilmington.

The job was completed, but defendant refused to pay claiming water still came into the building. Testimony from plaintiff indicated that water leaked into the building through the walls and not the roof. Defendant did not present any evidence to the contrary, nor did defendant present any evidence that the work was not done in a workmanlike manner. The only evidence presented by the defendant was that water still leaked into the building but there was no evidence presented on where these leaks were.

The Court finds for plaintiff, James M. Bender, Inc. in the amount of $425 plus costs and interest. IT IS SO ORDERED.
